Copyright refers to the author’s exclusive moral (non-property) and economic (property) rights in relation to their creation.
Copyright covers a wide range of literary and artistic works, such as literature, music, painting, choreography, sculpture, architecture, audiovisual works, scientific works, as well as computer programs, databases, and more.
The author’s moral rights are inalienable and non-transferable, while the author’s economic rights secure the author’s material interests, granting them the exclusive right to authorize or prohibit the use of their work or copies of it.
The use of a work includes reproduction, distribution, renting or lending the original or copies, translation, communication to the public, public performance, public display, broadcasting, revision, arrangement, illustration, adaptation, and other forms of transformation.
The author has the right to receive remuneration for every form of use of their work. The rates of copyright remuneration are established by a decision of the Government of the Republic of Armenia.
In most countries, and in accordance with the Berne Convention, copyright arises automatically from the moment a work is created, and under the current law it does not require registration.
Organizations for the Collective Management of Economic Rights
Organizations for the collective management of copyright and related rights are non-profit entities established directly by authors, performers, producers of phonograms, and other rights holders.Collective management of economic rights is a system widely applied in most developed countries. When the individual management of authors’, performers’, phonogram producers’, and their successors’ economic rights is difficult or sometimes even impossible, collective management organizations can provide the solution.In practice, collective management organizations act as intermediaries between rights holders and users. These organizations take on the authority to represent the interests of authors and their successors, conclude the necessary license agreements with users, negotiate the terms of use and remuneration, collect fees from users, and distribute the collected royalties among copyright and related rights holders.
